In order to think Art in its difference from the arts, I argue, requires that we take seriously its lack of sense. This lack is symptomatic of a historical rupture with the sense of art as_ technē_ (know-how), a sense that remains at play when one speaks of the arts. However, if art is not an art, then what is it? In this essay, I argue that art is a thing that makes sense absent. To specify art’s absent sense, its (...) absense, requires both a historical analysis of art’s rupture with _technē_ and the mastery it implies, and an ontological determination of the manner in which it makes of this loss a thing that serves to dumbfound. Art is thus inseparable from stupidity. Through an engagement with the work of Aristotle and Heidegger, Bataille and Balzac, Baudelaire, and Lacan, I suggest that art marks the extimate place of absense. (shrink)

Albert Camus’ views contributed to the rise of the philosophy known as Absurdism, he defines the Absurd “as the conflict between the human tendency to seek inherent value and meaning in life, and the human inability to find any meaning in a purposeless, meaningless, and irrational universe, with the ‘unreasonable silence’ of the universe in response.” However, this world in itself is not absurd, what is absurd is our relationship with the universe, which is irrational. Camus is considered to be (...) an existentialist, even though he firmly rejected the term throughout his lifetime. He is properly categorised as an atheist existentialist. However, he would also disagree with this label. In his notebooks, he presents the following contradictory statement: -/- “I do not believe in God and I am not an atheist.” -/- This reflects the notion of the Absurd. The search of the possibility of the existence of God is humanly impossible, but this also entails that the proof that God does not exist is impossible too. He writes in The Myth of Sisyphus: “In a universe suddenly divested of illusions and lights, man feels an alien, a stranger. His exile is without remedy since he is deprived of the memory of a lost home or the hope of a promised land. This divorce between man and his life, the actor and his setting, is properly the feeling of absurdity.” The Myth of Sisyphus is a fierce expression of the Absurd. It starts off with a powerful and thought-provoking statement: “There is but one truly serious philosophical problem and that is suicide. This is the guiding question of the field that we call ‘conceptual ethics’. Conceptual ethics is not often discussed as its own systematic branch of normative theory. This book reimagines the compositional semantics of comparative sentences using words such as more, as, too, and others. The book's central thesis entails a rejection of a fundamental assumption of degree semantic frameworks: that gradable adjectives like tall lexicalize functions from individuals to degrees, i.e., measure functions. I argue that comparative expressions in English themselves introduce “measure functions”; this is the case whether that morphology targets adjectives, as in *taller* or *more intelligent*; nouns, as in *more coffee*, *more coffees*; verbs, (...) such as *run more*, *jump more*; or expressions of other categories. Furthermore, she suggests that expressions that comfortably and meaningfully appear in the comparative form should be distinguished from those that do not in terms of a general notion of "measurability": a measurable predicate has a domain of application with non-trivial structure. This notion unifies the independently motivated distinctions between, for example, gradable and non-gradable adjectives, mass and count nouns, singular and plural noun phrases, and telic and atelic verb phrases. Based on careful examination of the distribution of dimensions for comparison within the class of measurable predicates, I tie the selection of measure functions to the specific nature and structure of the domain entities targeted for measurement. The book ultimately explores how, precisely, we should understand semantic theories that invoke the "nature" of domain entities: does the theory depend for its explanation on features of metaphysical reality, or something else? Such questions are especially pertinent in light of a growing body of research in cognitive science exploring the understanding and acquisition of comparative sentences. (shrink)

In the present paper, I analyze the complex relationship of tension between Critical Theory and phenomenology from a sociological-theoretical perspective. I start from two theses. The first one is that one of the primary reasons for the antagonism between these two paradigms lies in their ideal-typically opposed assessments of the role of ‘meaning-adequacy’ in social research. The second one is that in recent years, there has been a strong rapprochement of Critical Theory with (social) phenomenology. This shift, fundamentally embodied in (...) Hartmut Rosa’s work, can be understood as the culminating point of a progressive turn towards meaning-adequacy within the Frankfurt School. In order to unfold these two theses, I will proceed in three steps. First (1), I will present the main outlines of the relationship of tension between the two traditions from both a historico-intellectual and a systematic perspective. Second (2), I will focus on the contemporary readings of the Schutzian notion of ‘meaning-adequacy’ and discuss their value for better understanding the historical opposition between the two paradigms, as well as their recent rapprochement. Third (3), I will sketch the key features of Rosa’s sociology of world-relations, understood as a phenomenological Critical Theory that shows a strong commitment to a radicalized version of the meaning-adequacy postulate. Anabaptists have long been thought to have been ‘biblicists’ and shunned reading patristic literature. But a close analysis of the debates Anabaptists had with Magisterial Reformers shows that the Anabaptists developed an extensive history of baptism using church fathers. They attempted to show that adult baptism was the norm in the earliest centuries of the church and that infant baptism was the innovation away from the Bible. This debate was about who had inherited the biblical faith around baptism.

The first part of this article contains (i) considerations as to the relationship between jurisprudence and legal dogmatics, legal philosophy, and sociology of law; (ii) considerations about the status of jurisprudence both as a meta‐ and an object‐theory. These lead to the suggestion that jurisprudence should be defined as a general juristic theory of law and legal science. In the second part, the character and elements of this definition are explained systematically. The article's main thesis is that jurisprudence is not (...) distinguished from legal philosophy and sociology of law by its subject or its method, but by the specifically juristic research aspect or perspective it is based upon. Justice has a high status in Islamic societies, and as one of the most important human ideals, has long been the focus of thinkers and researchers. In fact, when the citizens do not understand the presence of justice in the behaviour of the officials of their society, their trust in the current procedures, and consequently the public participation will be affected. Considering the importance of the subject, the present study has been conducted with the aim of investigating the effect of (...) perception of justice on citizens’ trust and participation in the creation of a democratic Islamic society. The statistical population of this research included 3578 Indonesian Muslim citizens in 2022, and the research questionnaires were distributed among them. Data analyses were done using Statistical Package for the Social Sciences (SPSS) and Linear Structural Relations (LISREL) statistical software. The results of statistical analyses indicated that the perception of Islamic justice does not have a significant effect on the participation of Muslims in creating a democratic Islamic society. In addition, the perception of Islamic justice has a positive effect on the trust in officials of the Islamic society. Moreover, trust in the officials of the Islamic society positively affects the citizens’ participation in creating a democratic Islamic society.Contribution: According to the results of this research, it is necessary for the officials of the Islamic society to use all their efforts in creating a justice-oriented Islamic society in order to create trust among the citizens, and to involve Muslims in development decisions and to establish democratic Islamic society. In this paper, I intend to show the relevance of Schutz’s account of interpersonal understanding within the context of the contemporary social cognition debate. Currently, the research on the nature of everyday interpersonal understanding is taking place almost exclusively within the field of interdisciplinary cognitive science. Generally speaking, since the mid-nineties the so-called social cognition debate is dominated by two opposed theoretical outlooks which diverge concerning the ultimate mechanisms responsible for our understanding of Others, namely the theory-theory of mind and (...) the simulation theory. Yet, in the last couple of years, there is a phenomenological turn taking place in this debate. Thinkers like Zahavi, Gallagher and Overgaard, among others, return to classical phenomenological accounts of empathy—like those of Husserl, Stein, Scheler and Merleau-Ponty—to propose an alternative theoretical outlook on intersubjective understanding, namely the direct perception theory. However, this recuperation of classical phenomenological approaches to intersubjective comprehension is, to some extent, incomplete. Indeed, DPT supporters tend to neglect the valuable contributions that Schutz made to the study of this problem. This is quite curious, not only because Schutz’s phenomenological theory of interpersonal understanding agrees, to some degree, with the main thesis of the direct perception theory, but also because it contains of insights that may be helpful to formulate a more solid and self-clarified version of it. There are three general ways to approach reconciliation: from the side of nonfactualism, from the side of deflationism, or from both sides at once. To approach reconciliation from a given side, as I will use the expression, just means to attend in the first instance to the details of that side’s position. (It will be important to keep in mind that the success of an approach from one side may ultimately require concessions from the other side.) The only attempts at (...) reconciliation in the literature of which I am aware fall in to the first of these three categories. Such writers argue that the tension between our –isms can be resolved by paying sufficiently close attention to the nature of nonfactualism. While I have nothing against this approach in principle, I do have reservations about the particular proposals that have been made in its pursuit. The first section of the present paper briefly develops a line of objection against one such proposal, in order to motivate the approach to reconciliation from the side of deflationism. In section two, I argue that the deflationist can and should reject the inference from (2) to (3) above. Section three addresses a special problem of reconciliation for the nonfactu- alist who continues to use the discourse she takes to be factually defective. By paying close attention to the details of deflationism about reference, I show how a deflationist about truth might avoid this problem. I conclude that deflationism can be developed in a way that renders it compatible with nonfactualism. (shrink)

I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

In this article I discuss the little examined relationship between time and patient autonomy. Using the findings from a study on the experience of premenopausal cancer patients making fertility preservation decisions during their treatment, I focus on how the patients in the study understood time, and how this understanding interacted with and influenced their decision-making. I then analyse in more depth the importance of time in patient decision-making, and the relationship of time to concepts of patient autonomy and decision-making in (...) the field of bioethics more generally. Focusing on the relational conception of autonomy, I conclude that time is an integral part of patient autonomy which warrants further research, such that it can be better integrated into concepts of patient autonomy, and the policy and guidelines that they inform and influence. The manifesto presented in Philip Kitcher's exhaustive appraisal of contemporary American education—and the case for its potential reform—is so wide-ranging that it is not possible to do justice to its every component. Instead, I will speak to one of its parts in an attempt to recognize what I take to be the value of the whole. My aim is to address the section on the role of the arts in formal education, and the nature of aesthetic experience within that, to (...) test whether we can take the arts from their current state of being subject to Adam Smith's model of market utility, to being appreciated for their necessary and organic vitality. Kitcher provides strong arguments for exposure to the arts as leading to invaluable aesthetic experiences for young people. By extension—and at times by contrast—I will explore the possibility that the ‘aesthetic’ in aesthetic education does not just come into force with the student's encounter with art works or creative activity in the classroom, but should be integral also to the development of a particular sensibility amongst educators (i.e. the aesthetic education of the educators) for the shape and form of a ‘good’ education, according to its context and circumstance. It is through this sensibility that we might rediscover the necessity of the arts in schools at a time when their importance has been significantly devalued. (shrink)

This paper explores the conceptual history of academic freedom and its emergence as a substantive right that pertains to either the academic or the university. It is suggested that historical reconceptualisations necessitated by contingent circumstance may have led to academic freedom being seen as a form of protection for those working within universities whose national legislation recognises the right to teach and research without external interference, rather than as a responsibility to the wider society or to peers in other parts (...) of the world, who do not enjoy the privilege of that right. I explore the value of academic freedom as both right and responsibility, particularly taking into consideration the ethical implications for both at the international level in higher education. The present paper constitutes an attempt to articulate, systematize, and further develop the implicit traces of a phenomenological critical theory that, according to Michael Barber’s reading, are to be found in Schutz’s thought. It is my contention that a good way to achieve this aim is by reading Schutz against the background of novel, phenomenologically and hermeneutically informed accounts of Critical Theory in the tradition of the Frankfurt School, such as Hartmut Rosa’s. In order to achieve the stated objective, I (...) will proceed in four steps. First, I will briefly reconstruct the mostly negative reception of phenomenology, the interpretive social sciences, and Schutz by both the Frankfurt School and contemporary critical social theory. Second, I will present Barber’s alternative reading of Schutzian phenomenology as entailing an implicit ethics and a rudimentary critical theory based thereon. Third, I will sketch out Rosa’s formal model of Critical Theory as an heuristic means for articulating Schutz’s unspoken social-critical insights. Finally, establishing a dialogue between Barber’s reading of Schutz and Rosa’s account, I will provide a preliminary articulation of Schutz’s rudimentary critical theory. (shrink)

In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. This paper proceeds from the premise that film can be educational in a broader sense than its current use in classrooms for illustrative purposes, and explores the idea that film might function as a form of education in itself. To investigate the phenomenon of film as education, it is necessary to first address a number of assumptions about film, the most important of which is its objective character under study. The objective study of film holds that the meaning of film (...) awaits its correct interpretation according to an informed viewer. I suggest that theoretical modes of interpretation in this vein really amount to attempts to control meaning via a particular lens, rather than allowing films to present meaning in necessarily ambiguous, and thus sometimes unsettling, ways. Situating film as the object of study in this way continues a tradition of empiricism or naturalism in thought that both Maurice Merleau-Ponty and Ludwig Wittgenstein sought to critique as psychologism. Whilst no claim is made for reconceiving of Wittgenstein as phenomenologist, a dialogue between the Remarks on the Philosophy of Psychology and the Phenomenology of Perception reveals sympathies in attempts made by both to overcome a metaphysics of the perceived or experienced object, thereby broadening the educational reach of film. What is the relation between legal certainty and correctness? This question poses one of the perpetual problems of the theory and practice of law—and for this reason: The answer turns on the main question in legal philosophy, the question of the concept and the nature of law. Thus, in an initial step, I will briefly look at the concept and the nature of law. In a second step, I will attempt to explain what the concept and the nature of law, (...) thus understood, imply for the relation between legal certainty and correctness. Here three issues will be considered: first, the Radbruch formula as an answer to the problem of extreme injustice; second, the special case thesis, which claims that legal argumentation is a special case of general practical argumentation; and, third, the problem of the judicial development of the law. Recent weeks have seen an increased focus on the ethical response to the COVID-19 pandemic. Ethics guidance has proliferated across Britain, with ethicists and those with a keen interest in ethics in their professions working to produce advice and support for the National Health Service. The guiding principles of the pandemic have emerged, in one form or another, to favour fairness, especially with regard to allocating resources and prioritizing care. However, fairness is not equivalent to equity when it comes to (...) healthcare, and the focus on fairness means that existing guidance inadvertently discriminates against people from ethnic minority backgrounds. Drawing on early criticisms of existing clinical guidance (for example, the frailty decision tool) and ethical guidance in Britain, this essay will discuss the importance of including sociology, specifically the relationship between ethnicity and health, in any ethical and clinical guidance for care during the pandemic in the United Kingdom. To do otherwise, I will argue, would be actively choosing to allow a proportion of the British population to die for no other reason than their ethnic background. Finally, I will end by arguing why sociology must be a key component in any guidance, outlining how sociology was incorporated into the cross-college guidance produced by the Royal College of Physicians. Whether sociology should be part of bioethics has been extensively debated and critiqued. Feminist bioethics has long recognized the role of empirical work in bioethical inquiry; however, much feminist work in bioethics has been sidelined due to critiques of the role of social and sociological theory in bioethics research. In this essay, I examine how sociology plays a much deeper role in bioethical inquiry beyond the contribution of empirical methods. Building on these approaches, I show, through a case study, how (...) social and sociological theory play as vital a role in conducting comprehensive bioethical inquiry as sociological methods and methodology, and thus should no longer be sidelined in empirical bioethics. This article traces the recurrence of certain “obstacles” in the work of Paul de Man. My analysis centers on de Man’s essays on Romanticism in order to locate what he describes as a “shift” from “historical reflection” to the “problematics of reading.” De Man’s renewed attempts to describe this shift—and to name the obstacle that occasions it—draw on the very same language he uses in his reading of romantic texts. Focusing on de Man’s reading of Baudelaire and Hölderlin, in particular, (...) I examine the obstacles de Man identifies within the work of these authors, as well as the ways these obstacles disappear and resurface in later essays. Although I maintain de Man never succeeds in actually naming this obstacle, his repeated attempts to confront it attest to the importance—perhaps even the necessity—of stumbling as a constitutive feature of his critical project. These are the answers I gave to Brian Bix, Peter Koller, Ralf Posher, Torben Spaak, Timothy Endicott, and Jan Sieckmann at the end of a splendid conference day in 2018. The critique given to me concerned important aspects of three main themes in my work: the claim to correctness, human and constitutional rights, and the ideal dimension of law. Non-medical or Social egg freezing (oocyte cryopreservation) is currently a controversial topic in Islam, with contradictory fatwas being issued in different Muslim countries. While Islamic authorities in Egypt permit the procedure, fatwas issued in Malaysia have banned single Muslim women from freezing their unfertilized eggs (vitrified oocytes) to be used later in marriage. The underlying principles of the Malaysian fatwas are that (i) sperm and egg cells produced before marriage, should not be used during marriage to conceive a child; (ii) (...) extraction of mature egg cells from single women being unacceptable; and (iii) fertility preservation in anticipation of late marriage is a conjecture that has not yet occurred. Ovarian tissue freezing can potentially be a more Shariah-compliant alternative to social egg freezing, because once the frozen ovarian cortical tissue sections have been re-transplanted back into the woman, mature egg cells can readily be produced, collected, and fertilized by the husband’s sperm only during the period of marriage contract (′akd al-nikāḥ). Unlike accidental mix-ups with frozen eggs, muddling of lineage (nasab) would be automatically avoided in ovarian tissue freezing due to immunological rejection. However, upon critical analysis based on Qawā’id Fiqhiyyah (Islamic Legal Maxims), Maqāṣid-al-Shariah (Higher Objectives of Islamic Law), and Maslaḥah-Mafsadah (benefits versus harmful effects on society), elective ovarian tissue freezing by healthy single women for social reasons would likely be a highly contentious and controversial issue within Muslim communities that may conflict with conservative social-religious norms. This thus needs further debate among Islamic jurists in dialogue with medical doctors and biomedical scientists. (shrink)

We are frequently enjoined to eat in one way or another in order to reduce harm, defeat global warming, or at least save our own health. In this paper, I argue that individualism about food saves neither ourselves nor the world. I show connections between what Lisa Heldke identifies as substance ontologies and heroic food individualism. I argue that a conception of relational ontologies of food is both more accurate and more politically useful than the substance ontologies offered to us (...) by certain approaches to both veganism and carnivory. Since relationality does not in itself offer normative guidance for eating, I ask how eaters might better practice relationality. With particular attention to Potawatomi scientist Robin Wall Kimmerer’s invitation to settlers to “become indigenous to place,” I suggest that forms of relationality based in anarchist practices of “mutual aid” better offer white settlers, and eaters more generally, a political approach to relational ontologies while resisting a tendency towards epistemic and spiritual extractivism. I argue that mutual aid approaches have much to offer to the politics of food and eating at every scale. (shrink)

I wondered what their editors and contributors were writing now. I wondered about the work of their students and people like me: those of us who understand everything we write as indebted to the path-making, silence-clearing, generative, and bodacious work of the participants in the miracles that are This Bridge Called My Back and But Some of Us Are Brave.But today as I reread the contributions that actually emerged from this process, I realize that my dream was too small. I imagined writing that would provide evidence of the ongoing impact made by these two anthologies. Instead, the creative writing in this special issue offers something more crucial and beautiful than I had imagined. These works are not mere evidence of a transformed world; these works are continuing to transform the world in urgent and visionary ways. As repeated again and again by participants in the 2022 celebration for the fortieth anniversary celebration of This Bridge Called My Back, the work that inspired these anthologies is not over. The writings featured in this issue not only show [End Page 198] how this work continues, but they feed, nurture, and provoke us as we honor our responsibility to transform this world.For example, when Akasha Gloria Hull, coeditor of But Some of Us Are Brave, shares her daily early morning meditative writing in "Writing and Rebirth: A Set of Journal Poems," we remember not only her fundamental work excavating the daily lives of Black women writers from the nineteenth century—most notably in Give Us Each Day, her edited book based on the diaries of poet Alice Dunbar Nelson—but also our own imperative. Hull's reflections on health challenges, interpersonal conflict, resurrection, collaboration, and writing itself remind us that our feminist praxis is impactful because of its dailyness. Those of us who wake up tomorrow will need to ask the same critical questions the editors of But Some of Us Are Brave asked of the fields of Black studies and women's studies. We will find surprises and repetitions in the days we meet, and then we will have to do it again.When we read two new prose poems by Cheryl Clarke, an original contributor to This Bridge Called My Back, we have an opportunity to time travel. In "Living as a Lesbian in the Archive of Style," we venture into a critical engagement with the term "hardcore lesbian," displacing the desires of the person who needs to classify others using that term with those of someone who has been hailed by it. Clarke's poem is a reminder that as we work in literary traditions and fields of study made possible by the revolutionary identity politics of an earlier era, we are still responsible for centering the experiences of those most impacted by our fluent and fluid naming practices. In "History," Clarke offers us a timely Black lesbian feminist lens on many iterations of responding to police violence, centering the perspective of a lesbian, her lover, and her lover's husband.The poem "On Being an hbcu Graduate, Teacher, Professor-Scholar at Stillman College, Tuscaloosa, AL, in May 2015" by doris diosa davenport—an original contributor to But Some of Us Are Brave—highlights the intimacy, hilarity, and poignancy of the daily work of intergenerational critical and creative praxis. Before engaging with intentionality, the philosopher of mind must consider the intrinsic nature of psychological elements. Conscious states, contrary to ordinary and scientific objects, seem to penetrate each another in such a way that it becomes impossible to enumerate, class or organize through laws the various experiences at stake. In this context, how is a science of consciousness conceivable? How is it possible to apply the epistemological requirements of any science to a domain whose ontological nature contradicts such demands? The (...) paper reconstructs Husserl’s solution to this issue in the Fifth Logical Investigation. I show how his appeal to the mereological framework of the Third Investigation gives him the tools to rationalize the domain of the mind and to establish phenomenology as an authentic science of consciousness. I first demonstrate that the very task of phenomenological investigations is defined in mereological terms. I then reconstruct the issue regarding the inclusion of the intentional object within the act, by exposing the nuances of the Husserlian position in this famous controversy. In a last part, I show how mereological concepts are at the core of the Husserlian reinterpretation of the Brentanian thesis according to which all acts are presentations or based on presentations. Alfred Schutz is, without a doubt, one of the phenomenologists that contributed the most to the reflection on how to apply insights from phenomenological philosophy to the, empirical and theoretical, human and social sciences. However, his work tends to be neglected by many of the current advocates of phenomenology within these disciplines. In the present paper, I intend to remedy this situation. In order to do so, I will systematically revisit his mundane and social-scientifically oriented account of phenomenology, which, as (...) I shall show, emerges from a theoretical confrontation with the Husserlian distinction between transcendental phenomenology and phenomenological psychology. (shrink)

The contemporary philosophy of science (epistemology) featuring K.Popper, T.Kuhn, I.Lakatos, P.Feyerabend, Hanson among others, has exercised a decisive critique to the dominant views of the positivist and neo-positivist model of knowledge and has in fact undermined its credibility.

The aim of this paper is to systematically analyze Schutz’s phenomenological account of the typicality and habituality of everyday cognitive experience, and to identify the Husserlian leitmotifs that inform it. In order to do so, I will proceed in three steps. First, I will briefly present the main lines of Schutz’s theoretical project; second, I will scrutinize his Husserlian account of typification as a passive sort of interpretation; and finally, I will examine his –also Husserl-inspired– analysis of the structure and (...) genesis of the habitualized stock of knowledge at hand. This paper explores the nature of ourexperiences of values– ourvalueceptions. In the recent literature, two main standpoints have emerged. On the one hand, the ‘Meinongian’ side claims that axiological properties are experienced exclusively in emotions. On the other hand, the ‘Hildebrandian’ side contends that since valueceptions can be ‘cold’, they are not accomplished in emotions but rather reside in ‘value-feelings’ – emotions, in this framework, being conceived of asreactionsto the values thus revealed. The aim of the paper is to argue (...) that theHusserlianphenomenology of affectivity, especially as it is developed during his Göttingen period, can help to overcome these two accounts. I start by pointing out that, contrary to what most scholars have assumed so far, Husserl’s theory of valueception is not tantamount to Meinong’s, as it is very sensitive to ‘Hildebrandian’ arguments (Part 2). The core of the paper is then devoted to a systematic reconstruction of Husserl’s solution to this controversy. Drawing on the analogy between thing-perceptions and value-perceptions (Part 3), I show, first, that ‘cold’ valueceptions are to be identified with empty apprehensions (Auffassungen) of value, in which an emotion is notactually experiencedbut isanticipatedin such-and-such kinaesthetic circumstances (Part 4); second, that the realization of this anticipation amounts to thefulfillmentof the valueception (Part 5). As a result, Husserl acknowledges the relevance of ‘value-feelings’, yet his account appears more satisfactory than traditional ‘Hildebrandian’ theories in that it demystifies these ‘value-feelings’ by reducing them topotential emotions. Zhuangzi suggests that death is a transformation that we commonly and mistakenly think means the end of someone but really just marks a new phase of existence. This metaphysical thesis is presented at several points in the text as an explanation of distinctively Daoist responses to death and loss. Some take a Daoist response to death, as presented by Zhuangzi, to indicate dual perspectives on friendship and death. But I argue that the metaphysical view sketched above is consistent with a (...) unified perspective, allowing the Daoist to enjoy deep friendships without risking some potential for grief typically associated with strong attachment. However, it leaves the Daoist best suited to friendships with those who endorse the same metaphysics. Furthermore, while the grief associated with the death of a friend is somewhat mitigated, the Daoist has reason to mourn even given this thesis. (shrink)

This paper explicates and defends some of William James' more controversial claims in ‘The Will to Believe’. After showing some of the weaknesses in standard interpretations of James' position, I turn to James' Principles of Psychology and The Varieties of Religious Experience to spell out in more detail James' account of the nature of the attitudes of belief, doubt, and disbelief and link them to an account of the subject. In so doing, the moral force of the argument comes to (...) the fore by casting the question ‘Can we believe at will?’ in a new light. Through a discussion of the conversion experiences of The Varieties of Religious Experience and the kinds of self-transformations in which beliefs that once appeared dead become live that appear throughout James' psychology, the moral urgency of James' position in ‘The Will to Believe’ is clarified. La empatía ha sido foco de discusión en los círculos antipositivistas de la academia alemana de comienzos del siglo pasado, especialmente dentro del movimiento fenomenológico. El presente trabajo se concentra en el debate en torno a esta problemática que Alfred Schütz sostiene con Max Scheler en Der sinnhafte Aufbau der sozialen Welt. En el primer apartado se bosquejan los lineamientos principales de la teoría scheleriana de la Fremdwahrnehmung (percepción del otro), y en el segundo, se exponen las críticas que Schütz (...) le realiza a la misma sustentado en desarrollos teóricos de Edmund Husserl. La hipótesis que guía al escrito es que la confrontación con la teoría scheleriana de la Fremdwahrnehmung juega un rol fundamental en la configuración de la teoría del Fremdverstehen (comprensión del otro) del Schütz temprano. At the beginning of the 20th century the issue of empathy was subject of controversy within the phenomenological movement. The present paper deals with the debate on that topic that the young Alfred Schutz maintained with Max Scheler. Firstly, I outline the Schelerian theory of Fremdwahrnehmung (perception of the other), and secondly I present Schutz's criticism of the former, which is inspired by Husserl's insights on self-awareness and Einfühlung (empathy). My thesis is that in order to properly understand Schutz's theory of Fremdverstehen (understanding of the other) it is essential to take into account this early confrontation with Scheler. (shrink)

The central teaching of mysticism is that Everything is One, whereas from the side of rationalism the universe is Multiple. The essence of the mystical tradition is not a particular philosophical system, but the simple realization that the soul of any individual/existence is identified with the Absolute. A special feature of the mysticism is the elimination of discriminations, i.e. the One and the Multiple are identical.On the other hand, in rationalism the One and the Multiple differ substantially. Mysticism aims at (...) the Emptiness of Zero, whereas rationalism aims at the identification with the Infinite of Everything. Based on the ontology resulting from modern physics the One is also the Multiple and the Multiplicity is also a Module, also the Void and the Everything are complementary aspects of a single and indivisible reality. This means that mysticism and rationalism are the two sides of a Cosmic Thought, which isexpressed through consciousness. We could say that this consciousness is the rhythm that coordinates any opposite. (shrink)

How are we able to experience values? Two sides are competing in contemporary literature: ‘Meinongians’ (represented notably by Christine Tappolet) claim that axiological properties are apprehended in emotions, while ‘Hildebrandians’ (represented in particular by Ingrid Vendrell Ferran) assert that such experiences of value (or valueceptions) are accomplished in special ‘value feelings’, and that emotions are only responses to these felt values. In this paper, I study the Husserlian viewpoint on this issue. I reveal that, contrary to what almost all scholars (...) have assumed so far, Husserl’s position is not reducible to Meinong’s and must on the contrary be regarded as an innovative and stimulating approach that helps unifying the two standard frameworks. It indeed recognizes (with Hildebrandians) the existence of non-emotional value feelings, while maintaining (with Meinongians) that originary axiological experiences are necessarily emotional. That two theories of law are different does not imply that they differ in all aspects. Far more likely is the opposite state of affairs, namely, that there are some common points along with some points of disagreement. I will start with three points in which there seems to be at least some connection between Joseph Raz’s opinions and my own. In a second step, I will consider what is, perhaps, the most fundamental difference.

In his book Legality Scott J Shapiro presents a large-scale and sophisticated attempt to defend legal positivism in its most outspoken form, namely exclusive legal positivism. This, however, does not mean that morality plays no role in Shapiro’s analysis of the nature of law. On the contrary, he connects law with morality in myriad ways. This gives rise to the question of whether Shapiro’s theory of the nature of law is truly positivistic. In the article I argue that Shapiro’s theory (...) is, first, in crucial respects non-positivistic, and, second, in certain other respects indeed positivistic but in need of being converted into a non-positivistic theory. In , Sartre elevates the premature death of his father to the rank of a providential event which, by depriving him of a Super-Ego and relieving him of any legacy, consigned him to contingency and condemned him to be free. In this way, Sartre derives his uniqueness from this happy lack, this salutary void, i.e. a negated father, and casts himself in the role of an Aeneas liberated from the weight of his Anchises. Fatherless son, Sartre was nonetheless condemned to (...) return incessantly to a father who was destined to remain imaginary. The omnipresence of paternal figures in his oeuvre, from “Childhood of a Leader” to by way of and , is the expression of a double project, as systematic as it is paradoxical: to incarnate the Father, interrogate him and place him centre-stage—as he does with Flaubert's father—in order to eliminate all the better, through an unrelenting prosecution, that of which the Father is, in Sartre's view, the crystallization: the past, inheritance, the temptation of inauthenticity, the alienation of freedom by a foreign power. The Sartrean Father reveals in a privileged way the heart-rending paradoxes of freedom. French Dans Les Mots , J.-P. Sartre hisse la mort précoce de son père à la hauteur d'un événement providentiel qui, le privant de Surmoi et le délestant de tout héritage, le livra à la contingence et le condamna à être libre.
